1. Acceptance of Terms
By accessing and using Terapiku ("the Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
These Terms constitute a legally binding agreement between you ("User," "Therapist," or "you") and Terapiku ("we," "us," or "our").
2. Service Description
Terapiku is a cloud-based booking management SaaS designed for therapists, providing:
- Online Booking Management: Schedule and manage customer appointments.
- Customer Relationship Management (CRM): Track customer information and booking history.
- Google Calendar Integration: Automatic synchronization of bookings with Google Calendar.
- WhatsApp Integrations: Official WhatsApp Business API and Unofficial WhatsApp workflows for customer messaging, notifications, and conversation management.
- Analytics and Reporting: Business insights and performance tracking.
- Payment Integration: Subscription management and invoicing.
3. Account Registration and Security
Account Creation:
- You must provide accurate, complete, and current information.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must be at least 18 years old to create an account.
- One person or business entity per account.
Account Security:
- You are responsible for all activities under your account.
- Notify us immediately of any unauthorized access.
- We are not liable for losses due to unauthorized use of your account.
4. Google Calendar Integration
When you connect your Google Calendar to our Service:
- You grant us permission to create, update, and delete calendar events related to your bookings.
- You can disconnect Google Calendar integration at any time from your dashboard.
- Disconnection immediately revokes our access to your Google Calendar.
- We only access calendar events related to bookings created through our system.
- You remain responsible for verifying all appointments and managing your schedule.
- We are not liable for calendar synchronization errors or conflicts.
Your responsibilities:
- Ensure you have permission to connect the Google Calendar account.
- Monitor your calendar for accuracy.
- Report any synchronization issues promptly.
5. WhatsApp Business Integrations
Terapiku may offer two WhatsApp connection types:
- Official WhatsApp Business API: Used for critical customer-facing messages such as booking confirmations, reminders, receipts, customer replies, and compliant template messages.
- Unofficial WhatsApp Connection: Used for workflows that are not available in Official WhatsApp Business API, such as certain status, group, label, edit/delete, or growth automation features.
When you connect a WhatsApp Business Account through Meta Embedded Signup or manual credentials, you confirm that you are authorized to grant Terapiku access to that business asset and phone number.
Your WhatsApp responsibilities:
- Use WhatsApp features only for lawful business communication with your customers.
- Comply with Meta Platform Terms, WhatsApp Business Terms, WhatsApp Business Policy, Commerce Policy, template rules, messaging limits, and opt-in/consent requirements.
- Keep your business profile, display name, phone number, payment method, and template content accurate.
- Understand that Meta may reject templates, limit messaging, reduce quality rating, suspend numbers, or change pricing independently of Terapiku.
- Do not use Terapiku to send spam, prohibited content, misleading claims, regulated product offers, or messages without appropriate customer consent.
Terapiku provides tooling, routing, logging, and guidance, but we do not guarantee approval of WhatsApp templates, display names, business verification, messaging limits, quality rating, or continued availability of any Meta/WhatsApp account.
6. Subscription Plans, Meta Charges, and Payments
We offer different subscription tiers:
- Free Trial: 14 days full access for evaluation purposes, one-time only.
- Free Plan: Forever free with limited features, such as 1 treatment and basic booking management.
- Plus Plan: Advanced features including WhatsApp CRM, Google Calendar integration, unlimited treatments, and complete business management tools.
Payment Terms:
- Subscriptions are billed in advance on a monthly or annual basis.
- Payment is due at the start of each billing cycle.
- We accept payment through designated payment gateways.
- All fees are in Malaysian Ringgit (MYR) unless stated otherwise.
- Subscription fees are non-refundable except as required by law.
- Free Trial automatically converts to Free Plan after 14 days.
- Plus Plan automatically converts to Free Plan upon expiry if not renewed.
Meta/WhatsApp Charges:
- Official WhatsApp Business API messages may incur Meta charges based on Meta's current pricing, message category, destination country, and delivery status.
- If your own business payment method is attached to your WhatsApp Business Account, you are responsible for Meta charges billed directly by Meta.
- If Terapiku later offers a managed WhatsApp billing package, the package terms, spend caps, estimated charges, and responsibility for overages will be shown separately before activation.
- Terapiku subscription fees are separate from any Meta, payment gateway, SMS, cloud storage, or third-party platform charges unless explicitly stated in writing.
Cancellation and Refunds:
- You may cancel your subscription at any time.
- Cancellation takes effect at the end of the current billing cycle.
- No refunds for partial months or unused time.
- Access continues until the end of the paid period.
7. User Responsibilities and Acceptable Use
You agree to:
- Use the Service for legitimate business purposes only.
- Comply with all applicable laws and regulations.
- Maintain accurate and up-to-date information.
- Treat customer data with care and respect privacy.
- Report any bugs, errors, or security vulnerabilities.
You agree not to:
- Use the Service for illegal or unauthorized purposes.
- Attempt to gain unauthorized access to our systems.
- Interfere with or disrupt the Service.
- Copy, modify, or distribute our software or content.
- Use automated tools to access the Service without permission.
- Impersonate others or provide false information.
- Transmit viruses, malware, or harmful code.
8. Service Availability and Support
Uptime:
- We strive for 99.9% uptime but do not guarantee uninterrupted service.
- Scheduled maintenance will be announced in advance when possible.
- We are not liable for service interruptions beyond our control.
Support:
- Support is available through your dashboard.
- We aim to respond within 2-3 business days.
- Premium support may be available for higher-tier plans.
9. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your data.
10. Intellectual Property
- All content, features, and functionality of the Service are owned by us or our licensors.
- You may not copy, modify, distribute, or reverse engineer any part of the Service.
- Your customer and booking data remains your property.
- You grant us a limited license to use your data to provide the Service.
11. Limitation of Liability
To the maximum extent permitted by law:
- We provide the Service "as is" without warranties of any kind.
- We are not liable for indirect, incidental, or consequential damages.
- Our total liability shall not exceed the amount you paid in the last 12 months.
- We are not responsible for:
- Third-party service failures such as Google, WhatsApp, or payment gateways.
- Data loss, though we maintain regular backups.
- Business losses or missed appointments.
- Customer disputes or complaints.
12. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any rights of third parties.
- Your customer relationships and bookings.
13. Termination
By You:
- You may cancel your account at any time through your dashboard.
- Upon cancellation, your access continues until the end of the paid period.
By Us:
- We may suspend or terminate your account for violation of these Terms.
- We may terminate the Service with 30 days' notice.
- We reserve the right to refuse service to anyone.
Effect of Termination:
- You lose access to the Service.
- We may delete your data after a reasonable grace period.
- You should export your data before termination.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting updated Terms with a new effective date.
- Sending email notification.
- Displaying a notice in your dashboard.
Continued use of the Service after changes constitutes acceptance of the modified Terms.
15. Governing Law and Jurisdiction
- These Terms are governed by the laws of Malaysia.
- Disputes shall be resolved in Malaysian courts.
- If any provision is found invalid, the remaining provisions remain in effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements.
